Official Rules

1. Eligibility: TIMEX Expedition Return to the Outdoors Contest (the “Contest”) is open only to legal residents of the fifty (50) United States eighteen (18) years of age or older at the time of entry. Employees of Timex Corporation, their respective parent, subsidiary and affiliate companies, dealers, agents, advertising and promotion agencies and any other companies (or persons) that provide services in connection with this Contest, as well as the immediate family (spouse, parents, siblings and children and their respective spouses, regardless of where they reside) and household members (whether or not related) of each such employee, are not eligible to enter or win. The contest is subject to all federal, state and local laws and regulations. Void where prohibited or restricted.

2. Sponsor: The Contest is sponsored by Timex Corporation whose principal place of business is 555 Christian Road, Middlebury, CT 06762. (the “Sponsor”).

3. Agreement to Official Rules: Participation in the Contest constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling, as determined by Sponsor in its sole discretion, all requirements set forth herein. Except as otherwise stated in these Official Rules and in any other documents required to be delivered by entrants in connection with the Contest, personal information collected in connection with the Contest will be used in accordance with the privacy policy found on the Sponsor’s web site and with the consent of entrants upon time of entry.

4. Entry Period: The Contest entry period begins April 12, 2008 at 12:01 AM (Eastern Time) and ends September 16, 2008 at 11:59 PM (Eastern Time) (the “Entry Period”). Entries submitted prior to or after the Entry Period will be disqualified.

5. To Enter: Visit http://www.timexexpedition.com/Contest_Landing.htm during the Entry Period and complete the Contest registration form and select the entry category: (1) Media Entry or (2) Text Entry. Your entry (“Submission”) must meet the requirements set forth in herein. All materials submitted become the property of the Sponsor and will not be returned. Upon completing registration and submission click “submit”. You may enter as many sixteen (16) submissions, one per category in each of the eight (8) Semi-final Contest Periods, as long as the same (or substantially similar) submission is not entered more than one (1) time throughout the Contest Period.

6. CONTEST TERMS OF SUBMISSION: As conditions of entry into this Contest, and by uploading a media or text submission each Entrant:

  • WARRANTS AND REPRESENTS THAT THE ENTRANT OWNS ALL RIGHTS TO THE SUBMISSION HE/SHE IS ENTERING IN THIS CONTEST, INCLUDING, WITHOUT LIMITATION, THE VIDEO OR DIGITAL RECORDING, AND THE PERFORMANCE CONTAINED IN EACH SUBMISSION;
  • WARRANTS AND REPRESENTS THAT THE ENTRANT IS THE INDIVIDUAL PICTURED AND HEARD IN THE SUBMISSION, OR, ALTERNATIVELY, THAT THE ENTRANT HAS OBTAINED PERMISSION FROM EACH PERSON WHO APPEARS IN THE SUBMISSION TO GRANT THE RIGHTS TO THE CONTEST PARTIES DESCRIBED IN THESE RULES, AND CAN MAKE WRITTEN COPIES OF SUCH PERMISSIONS AVAILABLE TO THE CONTEST PARTIES UPON REQUEST;
  • WARRANTS AND REPRESENTS THAT HIS/HER SUBMISSION(S): (A) ARE ORIGINAL TO THE ENTRANT AND HAVE BEEN LEGALLY OBTAINED AND CREATED, (B) DO NOT INFRINGE THE INTELLECTUAL PROPERTY, PRIVACY OR PUBLICITY RIGHTS OR ANY OTHER LEGAL OR MORAL RIGHTS OF ANY THIRD PARTY, OR VIOLATE APPLICABLE LAWS, REGULATIONS, OR NETWORK STANDARDS; (C) HAVE NOT BEEN ENTERED IN OR WON PREVIOUS CONTESTS OR AWARDS; AND (D) HAVE NOT BEEN PUBLISHED PREVIOUSLY IN ANY MEDIUM;
  • Irrevocably grants to Timex Corporation, Active Marketing Group, Interactive Games and each of their respective affiliates, legal representatives, assigns, directors, officers, employees, agents and licensees, (the “Contest Parties”), the unconditional and perpetual right and permission to copyright (as appropriate), reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used), the Entrant's name, address, image, voice, likeness, statements, biographical material and Submission, including, but not limited to, the video or digital recording and performances contained in any of the above items (in each case, as submitted or as edited/modified in any way by the Contest Parties, in the Contest Parties' sole discretion), as well as any additional photographic images, video images, portraits, interviews or other materials relating to the Entrant and arising out of his/her participation in this Contest (with or without using the Entrant's name) (collectively, the “Additional Materials”) in any media now existing or hereafter created throughout the world for any purpose, without limitation, and without additional review, compensation (except if required by law), or approval from the Entrant or any other party.
  • Acknowledges and agrees that, if Entrant's Submission is chosen as a “Finalist” (as defined in Section 8 below), the Entrant will execute an Affidavit of Eligibility and Liability Release, in which the Finalist will irrevocably assign and transfer to the Sponsor any and all rights, title and interest in such Submission, including, without limitation, all copyrights, and waive all moral rights in that Submission.
  • Forever waives any rights of privacy, intellectual property rights, and any other legal or moral rights that may preclude the Contest Parties' use of the Entrant's Submission or Additional Materials, or require the Entrant's permission for Contest Parties to use them for any purpose, and agrees to never sue or assert any claim against the Contest Parties' use of those Materials or under any theory of contract or tort law; and
  • Agrees to indemnify and hold the Contest Parties and their respective affiliates, officers, directors, agents, co-branders or other partners, and any of their employees (collectively, the “Promotion Indemnitees”), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Promotion Indemnitees due to or arising out of the Entrant's Entry Materials or Additional Materials in this Promotion, or the Entrant's conduct during and in connection with this Promotion, including but not limited to trademark, copyright, or other intellectual property rights, right of publicity, right of privacy or defamation.
  • Agrees to release, indemnify and hold harmless Sponsor and the Contest Parties from any and all claims that any commercial, advertising, presentation, web content or any other material subsequently produced, presented, and/or prepared by or on behalf of Sponsor or the Contest Parties infringes on the rights of Entrant's work as contained in any Submission.

7. SUBMISSION FORMAT AND CONTENT REQUIREMENTS

Text Entry Submission Requirements

Technical Requirements- Media Submission

  • Video file(s) of any Submission entered in the Contest must be less than 150 seconds in length
  • The maximum file size for any single video file uploaded is 100 MB.
  • Video file(s) submitted must be provided in one of the following file formats: mpg; .mp4; .mov; .flv; .avi; .wmv



Judging Criteria as follows:

  • Adherence to Creative Assignment (40%)
  • Originality and Creativity (30%)
  • Overall Appeal (30%)

Additional Requirements

  • Submissions deemed unreasonably dangerous, illegal, or otherwise hazardous to people or property will not be considered.
  • Submissions must be in English
  • No swearing
  • No nudity
  • Nothing violent or offensive
  • No weapons
  • No drug use, smoking nor drinking of alcohol
  • No image and/or artwork that you did not create
  • Any materials that are unlawful
  • Nothing defamatory
  • No threats of violence
  • Submissions will not be returned. Contest Parties may, in their sole discretion, remove, delete and/or disqualify Submissions deemed to be inappropriate or otherwise non-compliant.
  • Submission must not contain any copyrighted works.
  • All submissions will be reviewed for content before being published or judged; however, such review does not relieve Entrant from responsibility for compliance with the Official Rules. Submissions that do not comply with the Official Rules or that otherwise contain prohibited, or inappropriate content as determined by the Judges, in its sole discretion, will be disqualified and will not be published or considered for a prize. Judges makes the final determination as to which Submissions are eligible to take part in this Contest and be considered for a prize.

8. 2008 SEMI-FINAL CONTEST AND GRAND PRIZE CONTEST FINALS:

The contest will be divided into Eight (8) Semi-Final Contest Periods and One (1) Grand Prize Final Contest as follows:

  • Semi-Final Contest 1 (4/12 – 4/24)
  • Semi-Final Contest 2 (4/26 – 5/8)
  • Semi-Final Contest 3 (5/10 – 5/22)
  • Semi-Final Contest 4 (5/24 – 6/5)
  • Semi-Final Contest 5 (6/7 – 6/19)
  • Semi-Final Contest 6 (7/24 – 8/5)
  • Semi-Final Contest 7 (8/7 – 8/19)
  • Semi-Final Contest 8 (8/21 – 9/2)
  • Grand Prize Finals Contest (9/4 – 9/16)

Determining The Contest Semi-Finalists: Each qualified entry received will be placed in one of eight contests based on the date of receipt of the entry, and will be screened by a panel of judges selected from the Sponsor’s marketing agencies, who will score each entrant's entry submission based on the Judging Criteria. The judges will choose the five (5) highest scoring finalists in the Media category and five (5) highest scoring in the Text category in each of the eight (8) Semi-final Contests. Odds of being selected will depend on the total number of entries received and the quality, as determined by the judges, of each entry. All winners of the Semi-final Contests will be selected by the judges in their sole discretion, and all contest entrants hereby waive any and all claims that they may have against the Sponsor, the judges, or any party acting on their behalf.

Public Voting to Select Finalist Winners: The Semi-Finalists selected will be posted on http://www.timexexpedition.com/Contest_Landing.htm for public viewing and visitors to the site will have the opportunity to vote for their favorite entrant based on the same Judging Criteria set forth above. The voting period to determine the Finalist winners will be begin April 12, 2008 at 12:01 AM (Eastern Time) and end September 2, 2008 at 11:59 PM (Eastern Time). The Semi-Finalist with the most votes in the Media category and most votes in the Text category in each of the eight (8) Semi-final Contests (sixteen (16) winners in total) will be declared the winners of the Finalist contests and advance to the Grand Prize Contest voting finals. Those Finalists that advance to the Grand Prize Contest voting finals are referred to as Finalists.

Public Voting to Select Grand Prize Winner:

The Grand Prize final voting period begins September 4, 2008 at 12:01 AM (Eastern Time) and ends September 16, 2008 at 11:59 PM (Eastern Time). The one (1) Finalist with the most votes in either the Media category or the Text category will be declared the winner. Grand Prize winner selected will be promoted on a site maintained by Sponsor any time between September 16, 2008 through September 30, 2008.

Voters must follow instructions on the web site to submit votes. Voters must be 18 years of age by April 12, 2008. Limit one vote per person per day. Subsequent votes by a single user will be disqualified. Your use of any automated voting system, or a professional Contest entry agent, to submit votes in the Contest is prohibited and will result in disqualification. Prize(s) will be awarded to each of the sixty-four (64) Semi Finalists, sixteen (16) Finalists and the one (1) Grand Prize Contest winner. In the event of a tie during any stage of the winner selection process, all tied entries will be re-judged, by the judging panel, in successive rounds until the tie is broken.

9. WINNER NOTIFICATION. The Sponsor will attempt to notify the potential winner(s) at the address provided by the entrant with his/her entry within ten (10) days of the end of voting. If the potential winner does not respond on or before 5:00 PM Eastern Time on the tenth day following the first attempt to contact him/her, the Sponsor will select an alternate potential winner from the next most highly ranked entrant among the finalists. The potential Grand Prize and Semi-Finalist Prize winner(s) will be required to complete and return an affidavit of eligibility and tax/liability/publicity release (the “Affidavit/Release”) within ten (10) days of being notified. If the potential winner fails to sign and return the Affidavit/Release within the required time period, an alternate winner may be selected in his/her place from the next most highly ranked entrant among the finalists. If the potential Grand Prize winner’s companion is a minor (under 18 years of age), his/her parent or custodial guardian must sign the Affidavit/Release on his/her behalf.

Background Check: Sponsor reserves the right to conduct a background check on any potential winner as part of the winner verification process, and entry in the Contest constitutes entrant’s consent to such background check. If Sponsor determines that a potential winner must sign an additional consent in order for Sponsor to be able to conduct such a background check, such potential winner must sign and deliver such consent or be subject to immediate disqualification. Sponsor further reserves the right to disqualify any potential winner if Sponsor determines in its sole discretion that awarding any prize to any such individual or identifying such individual in Sponsor’s promotional activities may reflect un-favorably on Sponsor.

10. Prizes: Grand Prize: One (1) Winner may choose from one of the three following vacation packages:

(1) Moab UT. Adventure Package, to include: Round Trip Air Transportation for two; Four day full size rental car; Three (3) nights hotel accommodations; One day river rafting; one day Mountain Biking, One day horse back riding.; One hour Hot Air Ballooning.

(2) Aspen CO Adventure to include: Round Trip Air Transportation for two; Three (3) nights hotel accommodations ; Four day full size rental car; One Hot Air Balloon ride includes food, champagne and video filming; One day rafting, unlimited Hiking.

(3) San Juan Islands WA Adventure Package, to include: Round Trip Air Transportation for two; Three (3) nights hotel accommodations; Four day full size rental car; One day kayaking, One day bike rental, ferry service between Islands. Each Grand Prize winner will also receive: (1) The North Face Lightweight rain jackets (Venture Jacket); (1) Camelbak Hydration Pak – Cloud Walker Day pack; (1) Timex Expedition watch. Grand Prize Winner and travel companion guest must travel on the same itinerary. Dates of trip are subject to availability of flights at time of reservation. Air transportation is round trip coach airfare for two from the nearest airport serviced by Sponsor’s designated carrier. All hotel accommodations are double occupancy. Car rental if included is a full size car unless otherwise specified (if winner is under 25 years of age a $100.00 a day transportation allowance will be provide in lieu of car rental). All expenses not specified are the sole responsibility of Grand Prize winner including, but not limited to, all hotels, meals, taxes, gratuities, visas, incidentals and transportation to gateway airport. All winners are responsible for any taxes and fees associated with receipt or use of any Prize. The Grand Prize winner and their travel companion guest will be required to sign a tax, liability and publicity release prior to travel. Approximate retail value of Grand Prize is $4090.00.

All prizes are non-transferable and non-refundable and must be accepted as awarded. No cash or other substitution may be made, except by the Sponsor, who reserves the right to substitute a Prize with another prize of equal or greater value if the Prize is not available for any reason as determined by the Sponsor in its sole discretion. Sponsor shall not be responsible for any delays or cancellations of events constituting part of the prize packages. Depictions of any part of the prize packages in any advertising or promotional materials may not reflect the actual prizes awarded to the winner.

11. Publicity: Except where prohibited, participation in the Contest constitutes winner’s (all prizes) consent to the Sponsor’s use of winner’s name, voice, likeness, testimonial, information and address for the purpose of advertising, trade or promotion, in any media now or hereafter, throughout the world in perpetuity, without further payment or consideration.

12. General Conditions: In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, that may cause the Contest to be disrupted or corrupted, the Sponsor may, in its sole discretion, either: (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules; or (b) award the unclaimed prizes at random from among the eligible entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it believes to be tampering with the entry process, the operation of the Contest, or acting in violation of these Official Rules, as determined by Sponsor. Any attempt by any person to undermine the legitimate operation or administration of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek redress to the fullest extent permitted by law. The Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

13. Release and Limitations of Liability: By participating in the Contest, entrants agree to release and hold harmless Timex Corporation, Active Marketing Group, Interactive Games and each of their respective parents, subsidiaries, affiliates, directors, officers, governors, employees, contractors, and agents, (“Released Parties”) from and against any claim or cause of action arising out of the entrant’s and the entrant’s guests’ participation in the Contest, or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, misdirected, or undeliverable entries; (e) the selection for the winners of the Semi-final Contests by the judges therof; (f) errors in the administration of the Contest or the processing of entries; or (g) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt of any prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Contest, and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, incidental, consequential, direct, or indirect damages.

14. DISCLAIMER OF LIABILITY FOR PRIZES. Sponsor and its respective parents, subsidiaries and affiliated companies (the "Sponsor Companies") maintain no control over the personnel, equipment, or operation of any air, water or surface carrier, ship line, bus or limousine company, transportation company, hotel, restaurant, or other person or entity furnishing service, products, or accommodations as a part of the prize provided under this Contest, since Sponsor is not in any way related to the other suppliers of these prizes. The Sponsor shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience, or other irregularity that may be caused or contributed to (a) by wrongful, negligent, or unauthorized act or omission on the part of any of those suppliers or any of their agents, servants, employees, or independent contractors, (b) by any defect in or failure of any vehicle, equipment, instrumentality, service, product, or accommodation, that is owned, operated, furnished, or otherwise used by any of those suppliers, (c) by the wrongful, negligent, or unauthorized act or omission on the part of any other person or entity not an employee of the Sponsor, or (d) by any cause, condition, or event whatsoever beyond the control of the Sponsor Companies shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience, or irregularity arising out of or relating to any prize granted under this Contest, even if caused by the negligence of the Sponsor Companies.
